Customer Services Agreement

Between Customer & BHNS Health Care

1. Definitions

  • “Company” refers to BHNS Health Care Private Limited.
  • “Customer” refers to any individual availing services.
  • “Service Provider / Staff” refers to caregivers, nurses, or attendants assigned by the Company.

2. Patient Information

The Customer must provide accurate and complete patient details, including physical and medical information. The Company shall rely entirely on such information.

3. Medical Disclosure

The Customer must disclose the patient’s exact medical condition and current status. The Company shall not be responsible for issues arising from incorrect or incomplete information.

4. Service Duration

Services are provided based on selected duration plans. Extensions are subject to availability and revised terms.

5. Registration Fee

A non-refundable registration fee applies based on service duration:

  • ₹3,000 (up to 90 days)
  • ₹6,000 (above 90 days)

6. Payment Terms

  • Payments must be made between the 1st and 5th of each month.
  • Delays may attract penalties.
  • Non-payment may result in suspension or termination of services.

7. Advance Booking

Advance booking is subject to availability and confirmation by the Company. No booking is guaranteed unless confirmed.

8. Cancellation & Refund Policy

  • Cancellation within 7 days: Partial refund (excluding registration fee)
  • Cancellation after 7 days: No refund
  • No refund in case of patient death

9. Use of Services

Staff must be used strictly for patient care. Assigning unrelated or domestic work is not permitted.

10. Non-Solicitation

Customers shall not directly hire or engage Company staff outside the Company.

11. Staff Leave Policy

Staff are entitled to 2 days of leave per month. Replacement is not guaranteed.

12. Non-Disclosure

Customers shall not inquire about or discuss staff salary or internal arrangements.

13. Security & Valuables

Customers are responsible for safeguarding valuables. The Company is not liable for any loss or damage.

14. Staff Safety

Customers must provide a safe and respectful environment. Misconduct may lead to legal action.

15. Medical Disclaimer

The Company provides only support services and does not offer medical advice or treatment.

16. Service Modifications

The Company reserves the right to modify services, staff allocation, and charges.

17. Legal Jurisdiction

These terms are governed by Indian law. Bengaluru courts shall have jurisdiction.

18. Inspection & Supervision

The Company may conduct inspections. Customers must cooperate.

19. Service Commencement

Services begin only after registration, payment, and staff assignment.

20. Professional Boundaries

Customers must maintain professional relationships with staff.

21. Off-Duty Responsibility

The Company is not responsible for staff actions outside working hours.

22. Customer Communication

Only the registered Customer shall communicate with the Company.

23. Labour Compliance

Customers must ensure fair and lawful treatment of staff.

24. Binding Agreement

By using the services, the Customer agrees to these Terms & Conditions.

25. Indemnity

The Customer agrees to indemnify the Company against losses arising from:

  • Customer negligence
  • Incorrect information
  • Misuse of services
  • Third-party claims

26. Limitation of Liability

The Company’s liability is limited to the service fees paid and excludes indirect or consequential damages.

27. Force Majeure

The Company is not responsible for delays caused by events beyond its control (e.g., natural disasters, pandemics, government restrictions).

28. Severability

If any clause is invalid, the remaining terms remain enforceable.

29. Entire Agreement

These Terms constitute the complete agreement between the Company and Customer.

30. Waiver

Failure to enforce any provision does not constitute a waiver of rights.

31. Amendment & Assignment

  • The Company may update these Terms at any time.
  • The Company may assign its rights without prior notice.
  • Customers may not assign their rights without consent.

32. Fair Service Commitment

The Company will make reasonable efforts to provide trained staff but does not guarantee specific outcomes.
